On 28 November 2023, The High Court of Kenya held that the housing levy as framed in Finance Act, 2023 is unconstitutional. Subsequently, the government gazetted the Affordable Housing Bill 2023 as an attempt to cure the highlighted defects from the court judgement. Furthermore, the government made an appeal and while pending the hearing and determination of the same, it sought a stay of execution/conservatory orders. Today's podcast analyses the intricacies of the bill vis a vis the two court decisions.
