Honest Takes
Legal podcasts about the Supreme Court can be evaluated the same way news programs are (the quality depends on what gets covered, how much you trust the commentators, and the chemistry between the hosts). Will Baude and Dan Epps are really trustworthy commentators. They talk with humility, admit their blind spots, and never say things in bad faith. Their chemistry makes the podcast special. Baude’s trust in the justices contrasts with Epps’s cynicism and the arguments about good faith and bad faith are entertaining (and I think educational, but that’s secondary). The topic areas might be an area for improvement. I understand the appeal of doing all the recent big decisions, but I don’t think there’s a need to limit yourselves to current events. If you both care about a case from 5 years ago that has implications today, talk about that instead. The other thing is that spending an hour on one case is more entertaining that splitting that hour for three cases (no need to cover all the decisions). This is just my two cents on what makes for interesting cases as someone who’s not a lawyer but I find the episodes more divorced from case law and about severability or some fed courtesy stuff more interesting (Arthex, Yellen, SB8). On the other hand, first and fourth amendment cases are very hard to follow and the discussion seems to be [insert case] from 1963 is kind of unclear but I guess the majority and dissent have a point (Lange, Ramirez, Brnovich).

More reviews of Divided Argument
I love this. You could occasionally do a look back at key decisions from each court that are still used as precedent.

The best legal podcast dealing with the week to week issues before the Supreme Court. Essential listening. My only frustration is the long periods of time where the podcast feed goes dark.

Like to see a left leaning lawyer paired with a right leaning lawyer, both with time at the Supreme Court explaining what is happening at the court. I’m a non-lawyer and they break it down so even I can understand.
