Could you please have a dedicated episode on the risks of automatic unfair dismissals (less than 2 years service) where claims are then brought in SPECIFIC for alleged RACE Discrimination that end up in an ET (Direct/Indirect).
Other than general information, there doesn’t seem to be much detailed information out there on “comparators” who are in different roles/level to the dismissed employee and if there is still a chance that the dismissed employee could still win or lose an ET if they could prove that another employee who didn’t share the same PC as them but was in a completely different role/level & never got dismissed for general poor performance like they did…
Could you also explain what’s meant by “material differences” and how this applies to comparators ex employees may rely upon?
