not libertarian
They way I see it, there are two broad categories of people who call themselves libertarian (with many subcategories within each). One category is the true freedom lovers, who understand on a deep conceptual level that government can't be trusted and should be a last resort for solving problems. The second category is people who are essentially conservative Republicans, and part ways (not very strenuously) with the GOP on just a few social issues like gay rights or abortion or drugs. If they're not discussing one of those few issues, they sound basically the same as Rush Limbaugh. Talk show hosts Neal Boortz and Glenn Beck are good examples of the latter. So is Richard Epstein. Epstein talks the talk that libertarians want to hear on a lot of economic issues. But listen long enough and you'll realize that he's not going to take the fight to right wingers on foreign policy or police state policies. He comes down on the side of government surveillance, sounding like a naive child the way he believes that the nominal, paper tiger safeguards the politicians put in place are good enough to prevent abuse. He's invested in The System and defends that system, going as far as to call Sen. Rand Paul "kooky". If this podcast were simply named The Richard Epstein Podcast, it would be a lot more defensible. But he had to go and appropriate the name "Libertarian" for a podcast that is in conflict with basic libertarianism on a lot of issues. For that reason, I advise you to STAY AWAY!Read full review »

This is the best 20 minutes you can spend in a week. Richard Epstein is an American treasure. A weekly dose of common sense thinking for a country is desperate need. Should be required listening for Congress.

While other reviews may imply that Richard Epstein is not a libertarian, as a libertarian myself I appreciate his unique views and opinions on the subject matter.
