“I’m disappointed in the simplistic analysis of Treaty Rights and the ongoing conflict between Indigenous and non-Indigenous fishers. The Marshall decision is clear that the Federal Government has a duty to regulate fish and animal stocks. Corey’s analysis is wrong when he stated Indigenous fishers can be poor stewards of the resource. The Federal Government has the authority to ensure the resource is properly managed by all. Other SCC decisions also discuss balancing the needs of Indigenous and non-Indigenous communities. The law is not all or nothing. The Feds cannot shut down the non-indigenous commercial fishery to the benefit of the indigenous fishery or vice-versa. In critiquing the Federal Government, you also failed to consider that the Feds have contributed over $300 Million to the Indigenous fishery in the region in order to train fishers, buy equipment etc. The Feds have not ignored Marshall and have not been static in addressing this situation. It is an issue that is far more complex than what you presented. Given the importance of reconciliation, we need a mature, thoughtful discussion around these types of issues. As for the RCMP, I am at a loss. Thanks”
