“I listened to the episode on why the border patrol is “exempt from the Fourth Amendment” and the inaccuracy of the explanation is unbelievable. For challenging constitutional topics, I recommend interviewing or at least consulting a legal expert, not some journalist who misconstrues the complex holdings in this area. Saying that there are zero fourth amendment rights within 100 miles of the border is simply a lie to incite panic. There’s a looser standard for assessing the reasonableness of searches near the border. I agree with the ideological starting point that this lowered standard is problematic in certain ways, but you can’t advance a good position on poor research and lies.”
