“I love the show, always interesting. The most recent episode on the Capitol Rioters had Ryan J. Reilly on as the cohost. Good reporting, I appreciated his insight to a point. Ryan suggested we should not be outraged when some rioters are charged with misdemeanors instead of felonies if they only entered the capitol carrying a sign. He is wrong. They should all be charged with felonies if that statute is available. These are not “protesters” in the classic sense. Non-violent protesters who refuse to disburse? Charge them with misdemeanors. People who climb through destruction caused by others in a sacred institution? They get felonies. Protesting something you don’t like? Pro-life, Pro-choice, against nuclear weapons, those protesters get misdemeanors when they refuse to disburse, impede others or trespass. Walk over downed security barriers, through broken doors, past broken windows, injured Capitol Police to roam the Capitol with signs promoting an insurrection? You get a felony. Do not normalize this behavior. Do they have to do jail time? Maybe not, be proportional in the sentencing, but they are charged with and should get a felony conviction.”
