Alford Plea
A good podcast that addresses the practical and actual issues often encountered in criminal proceedings. With that said, the Federal Judge in the Alford Plea podcast - I assume he was an Article III judge - was embarrassingly naive, and he thinks trials are necessary to ascertain the “truth.” I have to wonder has he ever actually practiced law. I find the truth is rarely determined in a criminal trial. He sounds like a judge that presumes the defendant must be guilty or why else was he arrested, completely out of touch with reality. Also, the Judge talks about the Defendant proving his innocence, no the State has to prove the Defendant is guilty beyond a reasonable doubt, the Defendant does not have the burden of persuasion or proof, and Alford Plea is used when Defendant is innocent but does not want to pay the trial tax, or was overcharged and faces possible sentences of 20 years - it becomes too risky to not enter an Alford Plea where Defendant can maintain his innocence but avoid the risk of excessive minimum sentencing.

Great production, and more importantly a great story with an unusual amount of information and cooperation from law enforcement. Looking forward to more episodes. My only wish is that podcasters would drop the personal endorsement type ads, just use a regular old ad produced by an agency.
