I had to stop listening. First of all the Host had the wrong witness (he’s describing the one who saw the defendant on 2nd floor not the one who was named in the defense subpoena.) Secondly, I just looked at the subpoena and it says “portion of information Ms. Funke has is exculpatory to defendant”. It does not say “may be exculpatory” and it doesn’t say let’s just put her on the stand and find out. I’m mostly a casual observer but this misinformation really got under my skin.
