The Brady Rule is a legal principle that requires prosecutors to disclose exculpatory evidence to the defense in criminal cases. The rule is named after the landmark U.S. Supreme Court case, Brady v. Maryland (1963), which held that the prosecution has a constitutional obligation under the Due Process Clause of the Fourteenth Amendment to disclose evidence favorable to the accused that is material to guilt or punishment. The Brady Rule applies to all evidence that is favorable to the defendant, including evidence that tends to impeach the credibility of a prosecution witness. The rule also requires the prosecution to disclose any evidence that is known to the government, whether or not the prosecution intends to use the evidence at trial. This includes evidence that is in the possession of law enforcement agencies, as well as evidence that is in the possession of other government agencies, such as intelligence agencies.
